TERMS AND CONDITIONS FOR RECORD APPLICATION

DEFINITIONS

  • ABWR: Africa Book of World Records Limited, the official record-keeping body.
  • Applicant: Any individual or organization submitting an application to set or break a world record.
  • Official Record: A verified and authenticated achievement documented by ABWR.
  • Record Attempt: The event or action undertaken by the applicant for recognition.
  • Participant: Anyone involved in organizing, supporting, or verifying the record attempt (e.g. witnesses, timekeepers, supervisors).

ACCEPTANCE AND AGREEMENT

  • Submission of an application constitutes full and unconditional acceptance of these Terms and Conditions.
  • All applicants are required to read and understand:
    • The Terms and Conditions
    • The Step-by-Step Application Guide
    • The Guidelines for Specific Records
    • Any additional notices or updates issued by ABWR.
  • Failure to comply with the terms or procedure may lead to disqualification or rejection of the application.

ELIGIBILITY CRITERIA

  • Applicants must be 18 years or older, or provide a parental/legal guardian consent form if under 18.
  • Applications are open to individuals, groups, institutions, or corporate bodies across the world.
  • Applicants and participants must be legally competent and not currently involved in any criminal investigation or litigation that could damage the credibility of Africa Book of World Records’ reputation.

APPLICATION PROCESS

  • All applicants must complete the three-stage application process:
    1. Pre-Event Application Form (initial concept and intent)
    2. Record Attempt Confirmation Form (final details before event)
    3. Post-Event Evidence Submission Form (proof and documentation)
  • ABWR reserves the right to:
    1. Request additional information or clarification at any stage.
    2. Accept or reject any application at its sole discretion without obligation to provide a reason.

APPLICATION AND FORMS

  • Applicants are required to complete the Pre-Event Application form. Other forms that may be required if the application is successful include:
    • Record Attempt Confirmation Form
    • Post-Event Evidence Submission Form
    • Timekeeper’s Form
    • Witness Form
    • Steward’s Form
    • Parental/guardian consent Form (for minor/underage)
    • Medical Professional’s Form (if applicable)
    • Media Consent FormVolunteer’s Form
  • All forms and documents must be filled truthfully and submitted within the stipulated timelines. Failure to comply may result in disqualification.

RECORD GUIDELINES AND APPROVAL

  • Upon provisional approval, ABWR will issue official guidelines that must be strictly followed, detailing the rules and requirements for the chosen record.
  • Any record attempt conducted without prior approval or that violate guideline compliance will be automatically disqualified.
  • Applicants must comply with all health and safety measures, ethical standards, and legal regulations applicable in their country or location of the attempt.

RECORD EVIDENCE AND SUBMISSION

  • All records must be accompanied by detailed evidence, including but not limited to:
    • Full video footage (continuous and unedited)
    • Photographic documentation
    • Signed witness and timekeeper statements
    • Log book
    • Media articles or public reports (if available)
    • Any other supporting documentation requested by ABWR.
  • Apart from the above requirements, specific evidence may be required for certain records.
  • Incomplete or tampered evidence may lead to disqualification.
  • ABWR reserves the right to:
    • Request additional evidence or clarification before verification.
    • Reject insufficient or unverifiable evidence.
    • All submitted evidence becomes the intellectual property of Africa Book of World Records Ltd (ABWR) and may be used for verification, promotion, archival, or other purposes.

FEES, PAYMENTS, AND REFUNDS

  • All payments made to ABWR are non-refundable, including application fees, administrative fees, express review fees, or any associated service charges.
  • No refund shall be granted in the event of disqualification, cancellation, withdrawal, or failure to complete a record attempt.
  • ABWR may charge certain non-refundable fees for specific application processing, express verification, customized guidelines, on-site verification, or printing services depending on the record.
  • Optional fees may apply for express review, certificate printing, shipping, on-site verification, and others.
  • Africa Book of World Records Ltd (ABWR) reserves the right to adjust the structure, pricing, and nature of its services and fees at any time without prior notice.

COMMUNICATIONS

  • ABWR will communicate with applicants via email and WhatsApp only, until a dedicated applicant dashboard is launched.
  • Applicants are responsible for checking their emails and messages for updates, correspondence, or decisions.
  • ABWR shall not be liable for missed communications due to incorrect email addresses, spam filters, or negligence by the applicant.
  • Applicants should note that all our official email addresses end with our customized domain i.e. “africaworldrecords.com” while our official WhatsApp number is +2348110005292.

POSTPONEMENT AND RESCHEDULING

  • Applicants who wish to postpone a scheduled record attempt must:
    • Notify ABWR at least 7 working days in advance
    • Submit a formal Postponement Notification stating reasons and proposed new date
  • Approval for postponement is not automatic and may be granted once only, except in emergencies. Further delays may require a fresh application.

INDEPENDENT FUNDING RESPONSIBILITY

  • All costs and logistics associated with planning, preparing, and executing a record attempt are the sole responsibility of the applicant.
  • ABWR will not provide financial, technical, or logistical support unless specifically stated in writing.

MEDIA RIGHTS AND PUBLICITY

  • By submitting any materials (names, videos, audios, images, documents, etc), the applicant grants ABWR a non-exclusive, worldwide, perpetual, royalty-free license to:
    • Use, reproduce, display, archive, promote, distribute, and publish submitted materials
    • Use content in print publications, online platforms, marketing, social media, educational purposes, historical purposes, archives, and any promotional campaigns
  • ABWR is not required to credit or compensate the applicant for such use.
  • Applicants are responsible for obtaining permissions for any third-party materials used in the submission.
  • ABWR may involve media coverage, interviews, or press releases related to the event or result.

OWNERSHIP OF EVIDENCE

  • The applicant retains ownership of the original evidence but ABWR reserves unlimited rights to use the materials as outlined in the Terms and Conditions.
  • ABWR will not entertain claims for royalties, licensing fees, or damages related to the use of submitted evidence.

DUAL RECORD SUBMISSIONS (OTHER ORGANIZATIONS)

  • Applicants may submit the same record attempt to other record organizations, but:
    • Must inform ABWR in writing prior to the attempt
    • Must ensure there are no conflicting or exclusive terms in other organization’s agreement
    • ABWR shall not be held liable for any legal, licensing, or usage disputes that arise due to dual submissions
  • ABWR reserves the right to reject or disqualify a record if another organization’s exclusive terms conflict with ABWR’s standards.

CERTIFICATE ISSUANCE AND RECOGNITION

  • Only successful record holders will receive one (1) free official ABWR Certificate of Achievement (digital) each.
  • No certificate (digital or physical) shall be issued in the case of disqualification or incomplete records.
  • Additional printed or framed certificates may be requested for a fee, including applicable shipping costs.
  • ABWR reserves the right to verify supporting participant roles before issuing certificates.
  • Participants such as witnesses, timekeepers, supervisors, and volunteers will receive Certificates of Participation, which will be emailed directly to them in digital format.
  • Printed or framed certificates for participants may incur additional costs, including courier or shipping fees.
  • All ABWR certificates contain security features to guard against forgery or duplication.

DISQUALIFICATION, MISCONDUCT, AND WITHDRAWAL

  • ABWR reserves the right to disqualify any record attempt if:
    • The record is executed without prior approval
    • Falsified or misleading evidence is detected
    • The event violates public decency or safety
    • Any of ABWR’s record guidelines, Terms, and Conditions are violated
    • The record promotes hate, violence, illegal, or unethical activity
    • The applicant disrespected ABWR staff or policies
  • Applicant may voluntarily withdraw at any stage by giving written notice; however, no refunds will be provided after application processing begins.
  • Disqualification decisions by ABWR are final and non-negotiable.

PUBLICITY, BRANDING, AND INTELLECTUAL PROPERTY

  • The use of the Africa Book of World Records’ name, logo, tagline, or related brand elements for any promotional or commercial purpose requires written authorization.
  • Any of ABWR’s intellectual property must not be used for promotion or branding without prior written permission.
  • Misuse or misrepresentation will lead to immediate disqualification and may result in potential legal action.
  • ABWR reserves the right to:
    • Publicly announce successful records
    • Include applicant names, images, or brand in ABWR reports, websites, and books

PRIVACY AND CONFIDENTIALITY

  • Applicant data will be handled according to Nigeria’s Data Protection Regulations or applicable international laws.
  • ABWR will not share sensitive information with third parties without consent, except where required by law.

AMENDMENTS AND UPDATES

  • ABWR reserves the right to modify these Terms and Conditions, including forms, procedures, eligibility rules, fee structures, and others at any time without prior notice.
  • It is the applicant’s responsibility to check for updates regularly.
  • Continued engagement with the ABWR system implies acceptance of any updated terms.

RISK ACKNOWLEDGMENT AND LIABILITY TERMS

1. No Warranties or Guarantees

Africa Book of World Records Limited (ABWR) provides its services, platforms, application processes, and communications strictly on an “as-is” and “as-available” basis. ABWR makes no warranties, representations, or guarantees of any kind – express, implied, statutory, or otherwise – regarding the availability, accuracy, reliability, or completeness of any services or information provided through its platforms or representatives.

ABWR does not guarantee:

  • That any record application will be approved.
  • That any record attempt will be successful or recognized.
  • That a certificate will be issued if the necessary guidelines are not met.
  • Continuous access to our platforms or uninterrupted communication due to external factors such as technical issues, power outages, or third-party service disruptions.

2. Applicant’s Responsibility

All record attempters and stakeholders acknowledge that they participate in ABWR-related events, activities, or application processes voluntarily and at their own risk. It is solely the responsibility of the applicant or attempter to ensure:

  • Their personal and team safety.
  • Full adherence to ABWR guidelines and legal requirements.
  • That their activities do not violate any local, national, or international laws.

ABWR shall not be held liable for any personal injuries, death, financial losses, property damages, legal actions, or reputational harm arising from:

  • Attempted or actual participation in any record activity.
  • Misuse or misrepresentation of the ABWR name or brand.
  • Failure to comply with ABWR requirements, including deadlines and procedures.

3. No Liability for Third Parties or Events

ABWR shall not be liable for the conduct, statements, or actions of third parties, including:

  • External sponsors, partners, or event collaborators.
  • Independent timekeepers, witnesses, volunteers, contractors, and others.
  • Misleading claims made by unauthorized persons about record approvals or endorsements.

ABWR shall not be held responsible for any losses or damages resulting from:

  • Miscommunication between applicants and third parties.
  • Unauthorized usage of ABWR content, brand, logo, or name.
  • Technical problems beyond our control (e.g., loss of submitted evidence, file corruption, delayed emails).

4. Limitation of Liability

To the fullest extent permitted by applicable law, under no circumstances shall ABWR, its directors, employees, agents, representatives, affiliates, or partners be liable to any party for:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Any loss of data, profits, reputation, or goodwill.
  • Any failure or delay in performing obligations due to force majeure events or reasons beyond reasonable control.

Total liability of ABWR to any user or applicant, regardless of the nature of the claim, shall not exceed the actual amount paid by that applicant for the specific application or service in question.

5. Indemnity

By submitting an application or participating in any ABWR-related event or record attempt, you agree to indemnify, defend, and hold harmless Africa Book of World Records Limited (ABWR), its directors, staff, agents, partners and affiliates from any and all claims, liabilities, lawsuits, damages, accidents, injuries, losses, expenses, or third-party disputes (including legal fees) arising out of:

GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by the laws of the Federal Republic of Nigeria, and any disputes shall be subject to the exclusive jurisdiction of Nigerian courts.

ACKNOWLEDGMENT AND AGREEMENT

By submitting an application, the applicant and participants acknowledge and agrees that:

  • They have read, understood, and accepted all Terms and Conditions stated herein.
  • They have read and understood the official Steps to Apply provided by Africa Book of World Records Ltd.
  • They are legally authorized to make this application and participate in the record attempt.
  • They agree to be bound by the decisions of Africa Book of World Records Ltd (ABWR), which are final and non-contestable.
